1 Introduction

We are pleased that you have decided to use cardcluster ("cardcluster", "we", "us", "our"). cardcluster provides an extensive range of tools and resources around the Yu-Gi-Oh! trading card game as well as complementary products and services. By registering and agreeing to these Terms of Use, you enter into a binding contract with the company mentioned in section 17 (Contact).

In order to use cardcluster, (1) you must be 18 years of age or older or 16 years of age or older and have the consent of your parents or guardians to the agreements, (2) you must be authorised to enter into a legally binding contract with us and must not be prevented from doing so by applicable laws and (3) you must be resident in the European Union (EU) or in Switzerland. You also warrant that all information you submit to cardcluster in the course of the registration process is true, correct and complete and you agree to ensure this at all times.

2 Changes to these Terms of Use

From time to time, we may make changes to these Terms of Use for legitimate reasons, such as to improve existing features or add new features to the services or to make reasonable technical adjustments to ensure the functionality or security of the services, or for legal reasons.

If we make changes that affect the ongoing contractual relationship between you and us, we will notify you in advance by appropriate means (e.g. by e-mail) as appropriate to the circumstances. The changes will be deemed to be accepted unless you reject them within 30 days. If you do so, we will not make any changes that significantly affect the contractual balance between the services and any compensation you may provide in return. If you no longer wish to use the services under the amended Terms of Use, you have the option to cancel by contacting us.

3 Use of cardcluster

When using cardcluster, you have certain options to choose from, which are described in detail on our website and in Appendix A. Some options are available for free ("free services"). Other options require a payment before you can access them ("paid subscriptions").

4 Payment

You can purchase a paid subscription directly from us. You pay a monthly subscription fee in advance.

We charge a fee of 7.85 € for chargebacks of collected subscription fees via direct debit through your fault (e.g. if there are insufficient funds in your bank account). You have the right to prove that cardcluster has suffered less or no damage at all.

5 Right of revocation

Unless you have effectively waived your right of revocation, you have a statutory right of revocation as follows if you are resident in Germany:

6 Renewal, cancellation

The payment obligation to cardcluster for your paid subscription is automatically renewed at the end of the respective subscription period, unless you cancel your paid subscription before the end of the respective subscription period by clicking here. The cancellation will take effect on the day following the last day of the current subscription period and you will be downgraded to the free service.

7 Rights we grant you

cardcluster or the original right holders are the sole owners of all rights to the cardcluster services or contents. We grant you a limited, non-exclusive, revocable right to use the cardcluster services and a limited, non-exclusive, revocable right to use the content for personal, non-commercial purposes (together "access"). This access shall remain in effect unless and until terminated by you or by cardcluster in accordance with the Terms of Use. You warrant and agree that you will use the cardcluster services and the content for your own personal, non-commercial purposes and that you will not redistribute or transfer the cardcluster services or content. The cardcluster software and the content will not be sold or transferred to you and all rights of reproduction of the cardcluster software and the content remain with cardcluster and the original copyright holders even after installation on your PCs, mobile devices, tablets and/or other devices.

cardcluster is the sole owner of all cardcluster trademarks, company signs, logos and domain names ("cardcluster trademark features"). The agreements do not grant you any rights to use cardcluster trademarks, whether for commercial or non-commercial use.

8 Rights you grant us

In return, you grant us the right to use the processor, bandwidth and storage space on your device to provide the services to you during the time you use it.

If you give us feedback in connection with cardcluster services or submit ideas or suggestions ("feedback"), you acknowledge that this feedback is not confidential and you grant cardcluster the right to use your feedback without limitation and free of charge. Feedback is considered user generated content.

In order to provide the cardcluster services, it is necessary that you grant us certain rights with regard to your user-generated content. This is especially true if you decide to upload or post user-generated content protected by intellectual property rights (such as images or photos) on cardcluster.

For this reason, you grant cardcluster a non-exclusive, transferable, royalty-free, worldwide license to use, reproduce, make publicly available (e.g. for performance or exhibition), publication, translation, modification, creation of derivative works and distribution of your user generated content in connection with the services in any medium, whether solely or in conjunction with other content or materials, in any manner, process or technology now known or hereafter developed. This license is for the sole purpose of providing the cardcluster services to you and other users. As we also use service providers who support us in providing the cardcluster services, you allow us to have the user-generated content used by such service providers on our behalf, as far as this is necessary for the aforementioned purpose. Except for the rights granted separately herein, you retain all rights, including intellectual property rights, to user-generated content.

You may terminate this license at any time, subject to the provisions of this paragraph, by terminating the agreements with us. We would like to point out, however, that in order to maintain the operation of the cardcluster services and for information security purposes, we have to create backup copies and that user-generated content you may have deleted may still be contained in such backup copies for a limited period of time.

9 User guidelines

We have defined some basic rules which must be observed by everyone when using cardcluster services. The following is not allowed under any circumstances:

1. Transfer content from the cache of an authorized device to another device by any means;
2. Reverse engineering, decompiling, disassembling, modifying or creating derivative works based on the cardcluster services, the contents or a part thereof
3. Circumvention of the technologies used by cardcluster or third parties to protect the contents or services;
4. Sale, rental, sublicensing or leasing of the cardcluster services or the contents or a part thereof;
5. Manipulation of the services by using bots, scripts or other automated processes;
6. Sharing your password with another person or using the username and password of another person;
7. "Crawling" the cardcluster services or using other automated methods (especially bots, scrapers and spiders) to view, access or collect information from cardcluster services

You have the possibility to publish your own content on cardcluster (including for example texts, pictures, links to other websites and embedded YouTube videos). You assure that all content you post on cardcluster belongs to you or that you have the necessary rights to publish it, and that you do not post any content or register a user name that is subject to the following.

1. which are offensive, insulting, defamatory, pornographic, threatening or obscene
2. which are associated with political or religious topics;
3. which are unlawful;
4. which contain harmful content such as malware, trojans or viruses;
5. with which other users are harassed or bullied;
6. which impersonate another user or natural person or which are otherwise fraudulent, false, misleading or deceptive;
7. which involve the transmission of unsolicited mass mail or other forms of spam ("spam"), advertising mail, chain letters, etc;
8. which include commercial activities or sales activities such as advertising, sales promotions, competitions, sweepstakes or snowball systems which have not been explicitly authorised by cardcluster;
9. which link or refer to commercial offers of products or services or otherwise advertise commercial products or services, unless expressly authorised by cardcluster; or
10. which impair the cardcluster services or try to exploit weak points.

cardcluster reserves the right to delete or block such user-generated content which violates these guidelines. In any case, you are responsible for all user generated content posted by you.

10 Restrictions and changes to the services

cardcluster will make reasonable efforts to keep our services operational. Due to certain technical difficulties, maintenance work or tests, temporary malfunctions may occasionally occur.

You understand, consent and agree that cardcluster is not obligated to provide upgrades or updates of the services or to provide certain content via the services.

11 Support

cardcluster offers user support via e-mail (support@cardcluster.com). We make reasonable efforts to answer all support requests within a reasonable period of time, but we cannot promise that requests will be answered and/or answered within a certain period of time. The support is offered in German and English.

12 Term and termination

The agreements remain effective until they are cancelled by you or by cardcluster.

The agreements can be terminated by cardcluster as well as by you with a notice period of 14 days to the end of the month.

cardcluster may terminate the agreements for good cause or block your access to the cardcluster services for good cause, especially in case of unauthorized use of the cardcluster services and/or content and/or substantial or repeated non-compliance with the agreements on your part, whereby we will take your legitimate interests into account. In case you or cardcluster terminate the agreements or cardcluster blocks your access to the cardcluster services, you agree that cardcluster is only liable towards you according to the provisions of clause 14. Your legal right to terminate the agreement for good cause remains unaffected.

You can cancel your cardcluster account by requesting the deletion of your account in the settings or by contacting our support. You will receive a confirmation via e-mail as soon as your account has been deleted.

The provisions of the agreements, which must continue to apply, either expressly or by their nature, after termination of the conditions, shall continue to apply after termination, in particular the provisions of clauses 11, 12, 14, 15 and 16.

13 Disclaimer of warranty

YOU AGREE THAT THE FREE CARDCLUSTER SERVICES ARE PROVIDED "AS IS" AND "UPON AVAILABILITY".

UNLESS EXPRESSLY STATED OTHERWISE, THE TERMS OF THE AGREEMENTS ARE NOT TO BE CONSTRUED AS A NO-FAULT GUARANTEE.

14 Limitation of liability

Under the agreements, cardcluster is liable without limitation for damages due to intentional or negligent injury to life, body or health as well as for other damages based on intentional or gross negligence by cardcluster or its legal representatives or vicarious agents.

As far as cardcluster is not liable without limitation according to the provisions of the first paragraph, in case of a violation of an essential contractual obligation based on simple negligence, cardcluster's liability for damages or reimbursement of expenses is limited to the typically foreseeable damage. Essential contractual obligations are obligations, the fulfillment of which makes the proper execution of the respective agreements possible in the first place and on the fulfillment of which you regularly rely and may rely (cardinal obligations).

The liability of cardcluster due to the applicable product liability regulations remains unaffected.

Any liability of cardcluster beyond the above mentioned cases is excluded. In these cases, in case of problems or dissatisfaction with the cardcluster services, the only and exclusive remedy is to de-install the cardcluster software and terminate the use of the cardcluster services.

We are not liable for damages due to loss of data, insofar as the damage could have been prevented if you had made backup copies at reasonable intervals.

15 Severability clause, waiver and interpretation

Unless otherwise specified in the agreements, the invalidity or unenforceability of any provision of the agreements or any part thereof, regardless of the reason for such invalidity or unenforceability, shall not affect the validity or enforceability of the remaining provisions of the agreements.

Cardcluster's failure to enforce the agreements or a provision thereof does not constitute a waiver by cardcluster of its right to enforce them.

For the purposes of these terms of use, the words "specifically" and "included" and any variation thereof shall be construed as being followed by the words "without limitation".

16 Choice of law and place of jurisdiction

The law of the Federal Republic of Germany shall apply. cardcluster does not participate in dispute resolution procedures before a consumer arbitration board.

• Publish unlimited decks.
• You can choose the cover card per deck from the options provided.

• Bookmark cards in Favorite Lists.
• You can use the function to generate random starting hands.
• Publish unlimited decks.
• You can choose the cover card per deck from the options provided.
• The storage capacity of the watch list per deck is 100 cards.
• You can upload a custom wallpaper.
